By registering for 10K Her Way, you agree to provide us with various personal information including but not limited to your contact details and promises about your health (“information”). You represent and warrant that all information you provide is true, correct, current and up- to date. 

You can only register for the 10K Her Way event through the She SUPs website (bookings cannot be made via partner SUP Schools). You must complete our Booking Form online, agree to this Release and make payment for 10K Her Way to confirm your entry.  All sales are non-transferable and non-refundable. Please see our Prize Draw Terms & Conditions for further details regarding the prize draw.

Inherent Risks 

Whilst there are many benefits to the 10K Her Way event, like all physical activities it involves some risk of injury that is inherent to the activity “inherent risks”. The inherent risks include: 

unpredictable and dangerous surf and waves and weather conditions; sharks, bluebottle stings and other marine life; drowning; getting trapped; collisions with other SUP boarders or members of the public; collisions with equipment, jet skis, boats or similar; sun exposure, overheating; rips and currents; over-exertion, manoeuvres beyond your capacity; rocky or coral reef or the sea bed or the water bed generally; erratic or careless behaviours of the public.

Health and Safety Rules 

She SUPs has endeavoured to maintain the safety of 10K Her Way by encouraging all partnering SUP Schools to cancel their 10k Her Way events if the weather is inclement, and to always have sufficient and well qualified staff. However, we also require your co-operation in relation to health and safety. It is your duty to: 

  • ensure you are currently able to swim 50m; 

  • where you are unsure of your swimming ability you must wear a lifejacket and have the support of a partner SUP school;

  • possess a sufficient level of skill and physical fitness for safe participation; 

  • have no health problems that would make participation unwise; 

  • conduct your own risk assessment relevant to the circumstances before embarking on a paddle, including checking weather and wind and changing plans where necessary;

  • inform any staff and cease the paddle immediately if you feel any unusual discomfort (e.g., faintness, shortness of breath, high anxiety, chest pains); 

  • attempt only paddling routes that you feel capable of performing safely; and 

  • stop any paddle if you believe its unsafe. 

In case of an emergency, you authorise us, or the relevant SUP School to:

  • administer emergency first aid and/or CPR when deemed necessary by staff or volunteers; 

  • secure emergency medical care or transportation where we decide it is necessary; and 

  • seek any medical attention, treatment, surgery or administration of drugs by qualified and licensed medical personnel. 

You further agree to assume all costs of emergency medical care and transportation. 

Reliance on Advice disclaimer

We will be publishing various information about 10K Her Way on our website and through emails to participants. This may include information about weather conditions or other matters relevant to the event. We use our reasonable endeavours to ensure that the information is accurate, however, we cannot guarantee that it is accurate. You rely on this information at your sole risk. 

Content Permission Licence

You permit us to photograph and/or video the event and use the photographs for marketing and information purposes, or publications, exhibitions and professional awards. We also encourage you to photograph, video the event, but, by doing so you grant us a worldwide, royalty free, perpetual, irrevocable, non-exclusive licence to share those photos and use them for marketing and information purposes. Please tag us in all social media posts. 

Release and indemnity 

In consideration of permission to participate in the 10K Her Way event, you on behalf of yourself, your spouse, your heirs, your parents or guardians, personal representatives, and assigns [“Releasing Parties”]  release us from all Claims.  You also agree to indemnify us from and against any and all Loss and damage arising out of or in connection with any damage to third parties occasioned by, incident to, arising out of, or in connection with your or your child’s participation.

Definitions: 

We/ us/ She SUPs Vikki Weston t/as She SUPs [ ABN12300739503] and includes all its Representatives.

Claims means all claim, under statute, tort, contract or negligence, any demand, award or costs.

Loss and Damage means any direct, indirect, incidental, punitive, special, or consequential loss or damages of any kind, including but not limited to, any loss of profits, revenue, savings, loss of enjoyment, personal injury, death, negligence, trespass, property damage and legal costs. 

Representatives include any sponsors, affiliates, employees, volunteers, independent contractors, equipment providers, agents, and facility owners.
